General terms and conditions

1. scope of application

The following terms and conditions apply to all orders placed via our online store. Our online store is intended exclusively for consumers.

A consumer is any natural person who carries out a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, is acting in the exercise of their trade, business or profession.

2. Contractual partner, conclusion of the contract, correction options

The purchase contract is concluded with Beste Gesellschaft für Neues mbH.

The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order, using the correction facilities provided and explained for this purpose in the order process. By clicking on the order button, you place a binding order for the products contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been sent.

3. Language of the contract, storage of the contract text

The language(s) available for concluding the contract: German.

We store the contract text and send you the order data and our GTC in text form. For security reasons, the contract text can no longer be accessed via the Internet.

4. Terms of delivery

Shipping costs are added to the prices of the products listed. You can find more information on shipping costs in the offers.

Delivery is by mail only. Unfortunately, it is not possible to collect the goods yourself.

5. Payment

The following payment methods are available in our store:

Credit card
You enter your credit card details when placing your order. Once you have been legitimized as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize yourself with your access data and confirm the payment instruction to us. Once you have placed your order in the store, we ask PayPal to initiate the payment transaction. The payment transaction will be executed automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Payment by e-mail
After placing your order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account activated for online banking, legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Apple Pay
To be able to pay the invoice amount via Apple Pay, you must use the “Safari” browser, be registered with the Apple service provider, have activated the Apple Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the ordering process.

6. Retention of title

The goods remain our property until full payment has been received.

7. Transport damage

If the goods are delivered with obvious transport damage, please complain about these defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or to contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, it will help us to assert our own claims against the carrier or the transport insurance company.

8. Guarantee

Unless expressly agreed otherwise below, statutory liability for defects shall apply.
The following applies to used products: if the defect occurs after one year from delivery of the products, claims for defects shall be excluded. Defects occurring within one year of delivery of the goods may be claimed within the statutory limitation period of two years from delivery of the goods.

The above restrictions and reduced periods do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
- in the event of injury to life, limb or health
- in case of intentional or grossly negligent breach of duty and fraudulent intent
- in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on the observance of which the contractual partner can regularly rely (fundamental obligations)
- within the scope of a guarantee promise, if agreed or
- insofar as the scope of application of the Product Liability Act is opened up.

9. Liability

We are at all times liable, without limitation, for claims based on damage caused by us, our legal representatives or vicarious agents
- in the event of injury to life, limb or health
- in case of intentional or grossly negligent breach of duty
- in the case of guarantee promises, if agreed, or
- insofar as the scope of application of the Product Liability Act is extended.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on the observance of which the contractual partner can regularly rely (fundamental obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability shall be limited to the amount of the foreseeable damage at the time of conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages shall be excluded.

10. Dispute resolution

The European Commission offers a platform for online dispute resolution (OS), which can be found here. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
